Decree on Private Firearm Ownership and Trade

Firearm will be defined as a weapon that launches one, or many, projectile(s) at high velocity through confined burning of a propellant.

Explosive will be defined as a reactive substance that contains a great amount of potential energy that can produce an explosion if released suddenly, usually accompanied by the production of light, heat, sound, and pressure.

No individual will be permitted to privately own a firearm.

No individual will be permitted to own, carry, or possess explosives except under supervised conditions in a pre-approved, professionally appropriate environment. Pre-approved, professionally appropriate environments for explosives will be determined by the People's Commissariat for Internal Affairs. If the People's Commissariat for Internal Affairs does not directly articulate a policy on explosives then the law and courts will assume that there is no pre-approved, professionally appropriate environment for the use, possession, or carrying of explosives.

All firearms and explosives in the territorial boundaries of the Democratic People's Republic of Kirkland will be considered to exclusive property of the State.

Firearms and explosives brought into the Democratic People's Republic of Kirkland will immediately and automatically become the property of the State upon passing the boundaries of the Democratic People's Republic of Kirkland regardless of the final destination of the firearm in question.

Individuals bringing firearms or explosives into the Democratic People's Republic of Kirkland with the prior expressed consent of the People's Commissariat for Internal Affairs will be charged with illegally transporting a firearm which will be considered a High Crime.

Individuals possessing or trading firearms or explosives in the Democratic People's Republic of Kirkland will be wholly illegal and will constitute weapons trafficking which will be punished as a High Crime.

Individuals who are professionally required to own a firearm will be permitted, in certain cases, to keep their firearm at their residence.

Professions that require firearms will be members of the People's Armed Defence Forces and the Worker's Militia.

Only commissioned officers will be permitted to keep a firearm at their residence.

Under no circumstances will enlisted individuals be permitted to keep a firearm at their residence.

No military grade firearms may be kept in private residences.

Military grade will include all assault rifles, sniper rifles, machine guns, submachine guns, any fully-automatic firearms, explosives, grenades, or missile launching devices.

Only handguns will be permitted to be kept in private residences.

All individuals that are permitted to keep a firearm in their residence must have the firearm fully disassembled and inoperable at all times while the firearm in in the residence.

Firearms may not be used in personal defence outside a professional setting.

Any individual that uses a firearm to defend themself outside a professional setting will be charged with manslaughter which will be punished as a High Crime.

Individuals will not be permitted to buy, sell, trade, exchange, barter, or otherwise engage in an economic exchange with or for any kind of firearm or explosive.
