Article One and Four Constitutional Changes

Be it resolved that the following shall become Article One of the Constitution of the Democratic People's Republic of Kirkland.

[u][b]Article One: The Supreme People’s Congress[/b][/u]
[list][*]Section 1: All legislative power shall be vested in a Supreme People’s Congress.
[*]Section 2: Only members of the Communist Party of Kirkland may run for office in the Supreme People’s Congress.
[*]Section 3: No restrictions regarding the gender, age, race, religion, nationality, or sexual orientation may be placed on an individual to make them ineligible to hold office in the Supreme People’s Congress.
[*]Section 4: The term of office for the Supreme People’s Congress will be 3 months.
[*]Section 5: After the conclusion of the legislative term, a free election shall be held in which the entire population of the nation shall elect the individuals to serve in the Supreme People’s Congress for the next legislative term. No restrictions may be placed on individuals to make them ineligible to vote in the elections for the Supreme People’s Congress.
[*]Section 6: Representatives shall be apportioned among the several Republics of the Democratic People's Republic of Kirkland. For every three citizens residing in a Republic there will be one congressperson that will represent them in the Supreme People's Congress. Each Republic will be guaranteed at least one representative regardless of total population. To determine the apportionment, every four (4) months a census will be taken in each Republic to determine residency. The Supreme People's Court will be responsible for validating apportionment
[*]Section 7: The Supreme People’s Congress shall have to power to pass any and all measures that are deemed necessary for the advancement of communism in the Democratic People’s Republic of Kirkland. Bills may only be introduced for a vote upon being granted approval by the Chairman of the Supreme People’s Congress and after having been placed on the official legislative docket of the Supreme People’s Congress. Legislation may be passed with the approval of a plurality of the Congresspeople present at the time of a vote.
[*]Section 8: Measures passed by the Supreme People’s Congress shall superior any policies adopted by any Republic of the Democratic People’s Republic of Kirkland but will be inferior to this Constitution.
[*]Section 9: All speech made by Congresspeople during official debate of a proposal, be it on the floor of the Supreme People’s Congress or in one its constituent committees, shall be protected speech and no Congressperson may be accused of any crime for utterances made during official debate. This protection shall also extend to aides of Congresspeople who are acting in an official capacity for a Congressperson. This protection shall also extend to utterances made by individuals called upon to give official testimony to the Supreme People’s Congress.
[*]Section 10: The Supreme People’s Congress may not:
[list][*]pass ex post facto laws
[*]pass bills of attainder
[*]pass laws limiting the movement of persons inside the borders of the Democratic People’s Republic of Kirkland
[*]issue titles of nobility
[*]or suspend the issuance of writs of habeas corpus except in the cases of rebellion or invasion[/list]
[*]Section 11: All allocations of money must be approved by a simple majority of all the Congresspeople.
[*]Section 12: Declarations of war must be approved by a simple majority of all the Congresspeople.
[*]Section 13: Treaties must be approved by a simple majority of all the Congress People.
[*]Section 14: The raising of armies, or creation of naval and air forces must be approved by a plurality of all the Congresspeople.
[*]Section 15: A state of emergency must be approved by a simple majority of all the Congresspeople.
[*]Section 16: Repeal of decrees issued by either the Council of People’s Commissars or the Premier must be approved with a plurality of all the Congresspeople.
[*]Section 17: The Supreme People’s Congress shall have the sole power to form and approve the rules and other decorum to be followed by Congresspeople. Congressional rules must be approved by a simple majority of all the Congresspeople.
[*]Section 18: The Supreme People’s Congress shall have the power to award honorific titles. The Supreme People’s Congress may also commission awards to be bestowed on exemplary individuals.
[*]Section 19: At the commencement of each new legislative term the Supreme People’s Congress shall appoint from amongst its members a Chairman of the Supreme People’s Congress. Advisement and approval from the Political Bureau of the Communist Party of Kirkland is required in the appointment process for the Chairman of the Supreme People’s Congress. The Chairman of the Supreme People’s Congress will be considered the official head of government of the Democratic People’s Republic of Kirkland. The appointee must be approved by a simple majority of all the Congresspeople. The duties of the Chairman will include:
[list][*]to form the legislative agenda of the Supreme People’s Congress for the current legislative term
[*]to preside over debates of the Supreme People’s Congress
[*]to punish Congresspeople who breach the established rules and decorum of the Supreme People’s Congress
[*]to appoint Congresspeople to the various committees of the Supreme People’s Congress[/list]
[*]Section 20: The Supreme People’s Congress shall have the responsibility of appointing the Council of People’s Commissars. Advisement and approval from the Political Bureau of the Communist Party of Kirkland is required in the appointment process for the Council of People’s Commissars. Appointments to the Council of People’s Commissars must be approved with a simple majority of all the Congresspeople.
[*]Section 21: The Supreme People’s Congress shall have the responsibility to appoint the Premier of the Democratic People’s Republic of Kirkland. Advisement and approval from the Political Bureau of the Communist Party of Kirkland is required in the appointment process for the Premiership. Appointment of an individual to the Premiership must be approved by a simple majority of all the Congresspeople.
[*]Section 22: The Supreme People’s Congress shall have the power to appoint the Governors of the Republics of the Democratic People’s Republic of Kirkland. Advisement and approval from the Political Bureau of the Communist Party of Kirkland is required in the appointment process for Governors. Appointment of an individual to a Governorship must be approved by a simple majority of all the Congresspeople.
[*]Section 23: The Supreme People’s Congress shall have the sole power to issue a motion of no confidence against the Council of People’s Commissars and the Premier. Upon the passage of a motion of no confidence the subject(s) of the motion shall be immediately removed from office. After removal, the Supreme People’s Congress is required to immediately begin the appointment process in order to fill the now vacant process. In order for a motion of no confidence to pass it must be approved by a two-thirds majority of all the Congresspeople.[/list]

Article Four will have the following added to it:

[list][*]Section 11: The Supreme People's Court will validate all apportionment of congresspeople to the Supreme People's Congress. This validation will come in the form of a vote of all the justices of the Supreme People's Court. Validation will be granted with approval of a simple majority of all justices.[/list]
